General Terms and Conditions of POLLEO SPORT

PRICES

Polleo Sport (Polleo Adria d.o.o., Samoborska cesta 134, 10000 Zagreb, Croatia) guarantees that all personal customer data is protected. Only the data necessary to fulfill our obligations is collected. All customers are informed about how the collected data is used and asked for their consent on how it can be used. Customers have the option to request their names to be removed from the customer list so that their data is not used for marketing purposes. All data is strictly safeguarded and is accessible only to employees who require it for their duties. All employees of Polleo Sport, as well as all business partners, are obligated to keep private data confidential.

If we have mistakenly listed a product at an incorrect, lower price, we are not obliged to deliver the product to you at the stated, incorrect price if we have informed you of the error before sending the product. In such a case, we reserve the right to cancel your order. We always ensure that all prices are correctly listed. If we notice an error, we will inform you and offer the option to correct or cancel your order. If your order is canceled, we will refund the entire amount paid, including any costs.

CONCLUSION OF CONTRACT

The customer can select products from our range and collect them in a virtual shopping cart by clicking the "Add to Cart" button. By clicking the "Order" button, the customer submits a binding offer to purchase the items in the shopping cart. Before submitting the order, the customer can view the data at any time and make adjustments by using the provided buttons to remove items or change information.

Subsequently, we will send an automatic acknowledgment of receipt to the customer via email, listing the customer's order once again, which the customer can print using the "Print" function. The automatic acknowledgment of receipt merely documents that the customer's order has been received by us and does not constitute an acceptance of the offer.

For security reasons, the contract data is no longer accessible via the internet. However, it will be sent to you via email.

If the customer chooses the prepayment payment method, the contract is concluded after the customer's order when we request payment from the customer. The customer will also receive a separate order confirmation.

If the customer chooses cash on delivery as the payment method, the contract is concluded by sending a separate order confirmation.

Prior to making a purchase, the customer must confirm that they have read and agreed to the terms and conditions.

DELIVERY CONDITIONS

Payment in the country is made by prepayment, immediate transfer, credit card, or cash on delivery. In the case of prepayment, the customer transfers the invoice amount, which has been communicated to them by email or phone, to the following account:

PAYMENT METHODS

Our online payment transactions are processed through our partner Monri WSpay - Web Secure Payment Gateway (Monri WSPay).

The following payment methods are accepted:

  • Credit card (MasterCard, Visa, Diners, Maestro)
  • Revolut card

 

For credit card payments, the charge is made on the same day. When making a credit card payment, the customer provides the following details: cardholder, card number, credit card company, expiration date, CVV code. The data is transmitted using SSL encryption with a minimum of 256-bit key, making it inaccessible to unauthorized individuals.

Monri WSPay Usage Statement

Monri WSPay is a secure system for online payments, real time credit and debit card payments, and other payment methods. Monri WSPay ensures the buyer and the merchant with the secure card data entry and transfer, which is also confirmed by PCI DSS certificate. Monri WSPay uses 256-bit SSL encryption and TLS 1.2 cryptographic protocol as the highest protection standards for data entry and transfer.

User Privacy Notice

Polleo Sport takes data protection and privacy very seriously. We collect only relevant and necessary data to accomplish the specified purpose and to meet our obligations. Our buyers are informed about the way the collected data is used, moreover, they can control and determine how their personal data is used. Buyers can also decide whether they want their name removed from the list used for marketing campaigns.All user personal data is kept strictly confidential. It is available only to employees who require such data to perform their work tasks. All employees of Polleo Sport and business partners are obliged to demonstrate that their activities are compliant with the Data Protection Principles.

Statement about the Protection of Personal Data Transfer

Monri WSPay, being the processor of authorization and payment made by credit cards, uses personal data as the processor pursuant to the General Data Protection Regulation of the European Parliament and the Council no. 2016/679, and compliant with PCI DSS Level 1 Regulations for data transfers.

For prepayment, payment details are sent to the customer via email, along with the account number to which the total order amount must be paid. Payment can be made within 3 days through internet banking or by standard payment methods, such as at a bank or post office. Once the payment is visible in our system, the order will be shipped. If the order is not paid within 3 days, it will be automatically canceled. Payment via bank transfer / payment slip is possible through:

  • Online banking
  • Mobile banking
  • Payment at the bank, post office, etc.
  • PayPal

Google Pay allows for a quick, simple, and secure payment method during online shopping. The key to security and speed is that you no longer need to repeatedly create accounts or enter a large amount of data on the websites and apps of online retailers.

Apple Pay™

Apple Pay offers a secure and easy payment method for online shopping and can be used with various compatible devices (iPhone, Apple Watch, iPad, Mac, etc.). The key to security and speed is that you no longer need to repeatedly create accounts or enter a large amount of data on the websites and apps of online retailers.

You can use Apple Pay™ via your iPhone or Apple Watch for online payments in the Safari browser or in apps when Apple Pay is available as a payment option.

These terms and the individual terms of sale for individual products constitute the contractual offer of Polleo Sport, and with its registration, order, or any other form according to these terms, the user as a buyer confirms their agreement. Thus, the contract between the buyer and Polleo Sport is concluded.

The purpose and commercial purpose of this contract are the purchase of a product through the Polleo Sport webshop for an amount - the price of the product. The contract is concluded by means of remote communication (distance contract), namely: printed promotional materials with an order form, telephone, and the internet.

The orders represent an offer of goods or services. Polleo Sport reserves the right to reject these orders at any time.Any automatic acknowledgment of receipt merely confirms that the customer's order has been received by us and does not constitute acceptance of the offer. The contract comes into force and is binding from the moment when the goods are dispatched, and the recipient receives the delivery confirmation by email. The contract applies to goods and services for which Polleo Sport has confirmed delivery. Polleo Sport is not responsible for goods or services for which no delivery has been confirmed. The user receives the confirmation as mentioned in Article 3 of Directive 2011/83/EU.

Priority Order

  • We guarantee that your order will be processed, packed, and shipped within one day or no later than the next day after creation
  • Priority order is only available for available items
  • Orders with priority order will be processed and packed within 1-2 hours, ahead of all "standard orders"
  • There is the option to pay by quotation (you will receive the quotation by email). Note: In this case, the order can only be processed after payment is received, even if the priority order is selected, meaning the processing time may be 1-2 business days.
  • Once you have placed the order, it is no longer possible to change the payment method or delivery option
  • Orders with priority order will have shipping costs increased by 2.99 euros
  • Priority order does not guarantee delivery on the desired day/date. Priority order only means that the order will be processed, packed, and handed over to the delivery service as quickly as possible.

 

Contract Terms

The user can accept the offer from Polleo Sport in one of the following forms:

  • By selecting the payment method and completing the order as a registered user of Polleo Sport
  • By selecting the payment method and completing the order as a guest of Polleo Sport
  • By selecting the payment method and completing the order via the +43 660 843 8600 telephone number.

 

  1. In the process of registration or when creating a user account, the user is asked to choose a name and password and provide an email address. All required data must be accurate. The use of third-party data is prohibited.
  2. Registration or the customer account is created for one person and may not be transferred to third parties. The user is responsible for keeping their account details secure. The use of others' accounts is not allowed.
  3. For violation of the provisions of the terms of this chapter, Polleo Sport reserves the right to delete the registration or user account at its discretion without compensation for costs or damages.
  4. A contract is concluded between Polleo Sport and the user as a buyer by registration (which includes the payment of a product).
  5. The contract comes into force when the customer registers, meaning on the day when the customer accepts the proposed contract.
  6. After the contract is concluded, the customer will receive the following documents: the contract confirmation, that is, the pre-contractual notification. This document, as well as the notice of the possibility of unilateral termination of the contract, with the unilateral termination form for the contract.
  7. In the case of defects in the goods offered in the webshop, the provider is responsible for the defects in the goods they offer, in accordance with legal regulations, especially Austrian consumer protection law.
  8. In the event of a visible defect in the product upon receipt of the delivery (e.g., packaging damage), the customer is allowed not to accept the product, and they are not responsible for the delivery costs of such a product. For products that have been taken over by customers, it is assumed that there were no visible defects in the product.
  • If there are defects in the product that were not immediately visible and were determined by an authorized service (e.g., the product was damaged during transport or due to improper storage) that the customer noticed after opening the product without using or assembling it, meaning it has been put into operation, the customer may unilaterally terminate the contract, replace the product, or request a discount. 

  • Products for which we have provided warranties in accordance with the law and the manufacturer's warranty come with a warranty card. To ensure the warranty, the invoice and warranty card must be presented. The customer must keep the warranty card and the invoice. The warranty becomes valid from the date of the invoice. The expiration date of the warranty is also provided alongside the product description.

  • If the manufacturer issues a warranty card guaranteeing the functionality of the product for a specific period, the customer can, if the product is not functional, request that the product be repaired within a reasonable time or that they receive a functional replacement product. If the product is damaged while the warranty is still valid, it should be taken to the authorized service center indicated on the warranty card.

  • To claim a warranty, the customer must present the invoice. The customer is obliged to retain the warranty card and the invoice. If damages occur because the customer mishandles the product and/or does not follow the instructions, the warranty does not apply. Authorized services listed on the warranty card are authorized for spare parts and services.

    Warranty is provided in accordance with statutory provisions. It is limited to the statutory period of 24 months from the acceptance of the goods by the buyer or the completion of the service. If replacement or improvement is not feasible (not possible, too much effort, unreasonable, delay), the buyer is entitled to a price reduction or, if the defect is not minor, to rescission of the contract (conversion).
    Compensation for (defect) consequential damages, as well as other property damages, financial damages, and damages to third parties against the customer, unless it concerns a consumer transaction, is excluded.

    Any defects that occur should preferably be reported at the time of delivery or after they become visible, and failure to report them at the time of delivery or after they become visible does not affect the customer's warranty claims. If the purchase is a commercial transaction (B2B) for the customer, they must inspect the goods and immediately report any defects found within a maximum of 2 weeks after receipt. Our company is only liable for damages in cases of willful intent and gross negligence. This does not apply to personal injury or consumer transactions. If it is not a consumer transaction, the injured party must prove the existence of slight or gross negligence. Compensation for (defect) consequential damages, as well as other property damages, financial damages, and damages to third parties against the customer, unless it concerns a consumer transaction, is excluded. 

    Exercising the warranty does not limit the statutory warranty. In the case of consumer transactions, the risk of loss or damage to the goods during shipment only passes to the consumer once the goods are delivered to the consumer or to a third party designated by the consumer, other than the carrier. However, if the consumer personally concluded the transport contract without using a choice suggested by us, the risk already passes to the carrier upon delivery of the goods. 
     

  • The contracting parties agree to apply Croatian law.

 

If you purchase items in Polleo Sport stores, you do not have the right to return the goods (for a refund) in accordance with EU rules unless the goods are defective. If the goods are technically sound and meet all the above-mentioned return conditions, we can offer you a replacement product of the same or higher value.

ORDER CONFIRMATION 

The confirmation of the completed order, which includes all the details required by law (Directive 2011/83/EU, Article 3), will be sent to the customer by email after they complete the order. 

The language of the contract, order, and business is English.

DELIVERY CONDITIONS

The goods will be delivered within 5 to 7 working days by the shipping partner GLS. The customer will be informed about the delivery method after completing the order (via email or telephone, depending on the method of purchase). If the product is not immediately available, the provider will inform the customer about the possible duration of the delivery (either by phone or email). The customer can then choose to accept or cancel the delivery. If the customer cancels the delivery, they will be refunded within 30 days after the delay occurs, including default interest. 

The refund will be made as soon as the goods are received again by Polleo Sport or after confirmation by the delivery service that the goods have been returned. The refund will be made using the same payment method that the customer used.

ADDITIONAL DELIVERY CONDITIONS

Upon the arrival of the delivery, the customer is obligated to check for any damages and immediately inform the carrier if there are any, i.e., to reject the delivery if there are visible damages. The products are insured in case of loss during delivery. 

For consumer transactions, the risk of loss or damage to the goods during shipment only passes to the consumer once the goods are delivered to the consumer or to a third party designated by the consumer, other than the carrier. However, if the consumer personally concluded the transport contract without using a choice suggested by us, the risk already passes to the carrier upon delivery of the goods. 

DATA PROTECTION

Polleo Sport guarantees that all personal customer data will be protected. Only data that is necessary to fulfill our obligations is collected. All customers are informed about how the collected data will be used and asked for permission on how it can be used. Customers have the option to request the removal of their name from the customer list if they do not wish their name to be used for marketing purposes.

All data is strictly protected and is only accessible to employees who need it to fulfill their duties. All Polleo Sport employees, as well as all business partners, are obligated to maintain data privacy.

CHANGES

Polleo Sport reserves the right to make changes to these conditions and promises to inform all registered customers via email address. If you disagree with the changes and do not wish to accept them, please contact us with your complaints and refrain from using the webshop in the meantime.
